TERMS OF SERVICE

1. Agreement and Application

These Terms of Service ("Terms") govern your use of mobile applications developed by Budali Studios LTD ("Company", "we", "us", or "our"), including UnTint, Connect 8 Words, Real Kalimba, Real Cajon, Xylophone Melodies, Luminous Virtual Piano, and any future applications we develop (collectively, the "Apps").

By downloading, installing, accessing, or using our Apps, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Apps.

Parental Consent: If you are under 18, your parent or guardian must consent to these Terms on your behalf and will be bound by them regarding your use of the Apps.

2. Modifications to Terms

We reserve the right to modify these Terms at any time without prior notice. Changes become effective immediately upon posting updated Terms within the Apps or on our website. Your continued use of the Apps after such changes constitutes acceptance of the modified Terms.

3. Description of Services

App Features and Functionality
Our Apps provide various digital services including photo editing, music creation, word games, and other entertainment features. Specific functionality may vary by App and subscription level.

Subscription Services
Certain Apps offer premium features through subscription plans:

• Weekly auto-renewing subscriptions

• Annual auto-renewing subscriptions

• Subscriptions automatically renew unless cancelled before the current period ends

• Billing is handled exclusively by third-party platforms (Apple App Store, Google Play Store)

Service Modifications
We may modify, suspend, or discontinue any App features, with or without notice. We are not obligated to provide refunds for discontinued features or services.

4. Billing and Payments

Payment Processing
All subscription purchases are processed by third-party platforms. We do not collect or process payment information directly. Payment terms are subject to the respective platform's terms of service:

Pricing
Subscription prices are displayed within the Apps and may change at any time. Price changes for existing subscriptions will be communicated in advance according to platform policies.

Automatic Renewal
Unless cancelled, subscriptions automatically renew for additional periods of the same duration. You are responsible for managing your subscription through the respective app store.

5. User Responsibilities and Acceptable Use

Account Security
You are responsible for maintaining the security of your device and any account credentials associated with App store purchases.

Prohibited Uses
You may not:

• Reverse engineer, decompile, or attempt to extract source code from our Apps

• Distribute, modify, or create derivative works of our Apps

• Use our Apps for any unlawful purpose

• Attempt to circumvent subscription or premium feature restrictions

• Interfere with the operation of our Apps or servers

6. Intellectual Property Rights

Company Rights
All Apps, including their design, code, features, content, trademarks, and other intellectual property, are owned by Budali Studios LTD or our licensors. These Terms grant you a limited, non-exclusive, non-transferable license to use our Apps for personal, non-commercial purposes only.

User License Restrictions
You may not sell, transfer, sublicense, or otherwise distribute your license to use our Apps. Any unauthorized use terminates your license immediately.

7. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimers and Warranties

"As Is" Provision
Our Apps are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Guarantee of Service
We do not warrant that our Apps will be uninterrupted, secure, or error-free, or that any defects will be corrected.

9. Limitation of Liability

Damages Limitation
To the maximum extent permitted by applicable law, in no event shall Budali Studios LTD be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our Apps.

Maximum Liability
Our total liability for any claims arising from these Terms or your use of our Apps shall not exceed five dollars ($5.00) USD.

Jurisdiction Variations
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

10. Termination

Termination by Company
We may suspend or terminate your access to our Apps at any time, with or without cause or notice, including for violation of these Terms.

Effect of Termination
Upon termination, you must immediately cease using our Apps. Provisions of these Terms that by their nature should survive termination will remain in effect.

11. Governing Law and Dispute Resolution

Applicable Law
These Terms are governed by the laws of Ghana, without regard to conflict of law principles.

Arbitration
Any disputes arising from these Terms or your use of our Apps shall be resolved through binding arbitration in Ghana, conducted in English, except for intellectual property disputes which may be pursued in court.

Individual Basis
Disputes must be resolved on an individual basis and may not be brought as class actions.

12. Technical Requirements and Availability

Device Compatibility
You are responsible for ensuring your device meets the technical requirements for our Apps and for maintaining internet connectivity as needed.

Service Availability
While we strive to maintain consistent service, we cannot guarantee uninterrupted availability and reserve the right to perform maintenance that may temporarily affect access.

14. Severability and Integration

Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Budali Studios LTD regarding your use of our Apps and supersede all prior agreements and understandings.
